1. Acceptance of Terms
These Terms of Service (the "Terms") govern the use of the Biblio application (the "Application") published by BRAILCOM,o.p.s., Company ID 25066803, with registered office at Náměstí 5, 267 27 Liteň, Czech Republic (the "Publisher"). By downloading, installing, or using the Application, you agree to these Terms. If you do not agree, please do not use the Application.
The Application is distributed via Apple App Store, which is also subject to the Apple Media Services Terms and Conditions. In the event of any conflict between these Terms and Apple's terms concerning distribution and payments, Apple's terms prevail.
2. Description of the Service
Biblio is a paid subscription reading and listening application for iOS that aggregates textual books, audiobooks, periodicals, podcasts, and YouTube channels into a single accessible interface. The Application is designed for all readers with built-in support for assistive technologies (VoiceOver, Braille displays, screen magnification, dyslexia-friendly typography).
Application copyright is held by OUI Technology Ltd, United Kingdom, Company Number 10905437. BRAILCOM,o.p.s. publishes and distributes the Application under license.
3. User Account and Sign-In
The Application does not require a separate user account with the Publisher. User identification is handled through Apple ID (for App Store and iCloud sync) and optionally through a Google account (only for importing YouTube subscriptions, if the user activates that feature).
Access to some content sources (KTN, KDD) requires a separate account with the respective library. Those accounts are managed by third parties and are subject to their own terms.
4. Subscription and Billing
The Application is offered as an auto-renewing subscription via Apple App Store In-App Purchase. Price, billing period, and renewal conditions are displayed in the Application before purchase and in Apple App Store.
The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. To cancel, go to iOS Settings → Apple ID → Subscriptions. The Publisher BRAILCOM,o.p.s. does not have access to your payment instrument data — all payments are processed by Apple.
Refunds are governed by Apple App Store terms. Refund requests should be filed at reportaproblem.apple.com.
5. Third-Party Content
The Application provides access to content from the following external sources:
- Library and Printing House for the Blind (KTN) — a collection reserved for people with reading disabilities under the Marrakesh Treaty and §39 of Czech Act No. 121/2000.
- Library of Digital Documents (KDD.cz) — similar regime.
- Camelot (Newton Media) — periodicals under the same regime as KTN.
- Czech National Digital Library (NDK) — publicly available collection.
- Project Gutenberg — public-domain works.
- Podcasts — public RSS feeds and iTunes catalogue.
- YouTube — user's own channel subscriptions via YouTube Data API v3.
Copyright to the content belongs to the respective rights holders. The Application only provides access and does not store content on its own servers. Use of KTN, KDD, and Camelot content requires the user to meet the legal eligibility criteria (typically a declaration of reading-disability status under the Marrakesh Treaty).
6. Acceptable Use
When using the Application you agree to:
- not use the Application for illegal or harmful activities;
- not attempt to circumvent technical measures protecting third-party content;
- not redistribute content obtained through the Application beyond permitted personal use;
- not interfere with the operation of the Application, perform reverse engineering, decompilation, or other unauthorized modifications.
Violations may result in termination of your right to use the Application. For KTN/KDD/Camelot content, the rules of the respective library always apply — violations may have consequences there as well.
7. Intellectual Property
Copyright to the Application, its graphical assets, source code, and documentation belongs to OUI Technology Ltd or its licensors. Nothing in these Terms transfers any copyright or other intellectual property rights to the user. The user receives only a limited, non-transferable, revocable license to use the Application for personal purposes in accordance with these Terms.
The "Biblio" trademark has been in continuous use by the Accessibility Expert Group within the EU assistive-technology community for approximately twenty years.
8. Privacy
Personal data processing is governed by the Privacy Policy, which is an integral part of these Terms. In brief: BRAILCOM,o.p.s. does not operate any user-data servers, and the Application does not collect analytic telemetry or crash reports (except for optional AI-feedback telemetry, which can be disabled).
9. Disclaimer of Warranties
The Application is provided "as is". The Publisher does not warrant that the Application will always be available, free of errors, or that it will meet specific user expectations. The Publisher is not responsible for:
- availability and content of external third-party sources (KTN, KDD, Camelot, NDK, Gutenberg, YouTube, iTunes, RSS feeds);
- iCloud synchronization issues (operated by Apple);
- data loss caused by uninstalling the Application, deleting an iCloud account, or device failure;
- inaccuracies in automatic audio transcription (Whisper) or in AI-librarian responses.
The Publisher applies maximum effort to maintain the availability and quality of the service, especially for accessibility — no feature that degrades the experience of blind users is considered acceptable.
10. Limitation of Liability
To the maximum extent permitted by Czech law, the Publisher's liability for any direct or indirect damages arising from use of the Application is limited to the amount of subscription fees paid in the last 12 months. This limitation does not apply in cases of gross negligence or intentional breach of duties.
11. Termination
The user may terminate use of the Application at any time by uninstalling the Application and cancelling the subscription in Apple App Store. The Publisher may revoke a user's access in cases of material breach of these Terms (for example, attempts to circumvent third-party content protection).
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Czech Republic. Disputes are subject to the general courts of the Czech Republic according to the Publisher's registered office, unless mandatory law provides otherwise (e.g. for EU consumer disputes).
13. Changes to the Terms
Material changes to these Terms will be announced by the Publisher in the Application and on this page at least 14 days before they take effect. Continued use of the Application after the effective date constitutes acceptance of the new Terms. If you do not agree to the new Terms, please discontinue use of the Application and cancel the subscription in Apple App Store.
